For the use of the MiHub online platform and the purchase of products and services.

Important. These terms should be read together with MiHub Online's Privacy Policy and Returns, Refunds and Warranty Policy. Nothing in this document is intended to limit any non-excludable consumer rights under South African law.

1. Introduction and acceptance

1.1 These Terms and Conditions govern your access to and use of the MiHub Online website, mobile site, applications and related online services, including the ordering, sale and delivery of products and services through the platform.

1.2 The platform is operated by MiHub Online (Pty) Ltd ("MiHub Online", "MiHub", "we", "us" and "our").

1.3 By accessing the platform, creating an account, placing an order, clicking to accept these terms, or continuing to use the platform, you agree to be bound by these Terms and Conditions.

1.4 These Terms and Conditions apply to all users of the platform, including visitors, account holders and customers. They apply together with our Privacy Policy and Returns, Refunds and Warranty Policy.

1.5 The platform is intended for customers whose delivery address, return collection address and use of the platform are within the Republic of South Africa, unless we expressly agree otherwise in writing.

1.6 Nothing in these Terms and Conditions is intended to unlawfully limit, avoid or replace any rights you may have under the Consumer Protection Act, 68 of 2008 (CPA), the Electronic Communications and Transactions Act, 25 of 2002 (ECTA), the Protection of Personal Information Act, 4 of 2013 (POPIA), or any other applicable South African law.

2. Important consumer notice

2.1 Certain clauses in these Terms and Conditions may limit our risk or liability, create risk or liability for you, require you to indemnify us or another person, or require you to acknowledge certain facts. These clauses are important and should be read carefully.

2.2 If any clause is unclear, you should contact MiHub Online for an explanation before accepting these Terms and Conditions or continuing to use the platform.

2.3 We do not intend to exclude any liability or obligation that cannot legally be excluded under South African consumer law.

3. Definitions

SellerA supplier, manufacturer, distributor or service provider who lists or supplies products through the platform under an agreement with MiHub Online.
You / User / CustomerAny person who accesses or uses the platform, creates an account, places an order or purchases products or services.

4. Account registration, eligibility and security

4.1 You may be required to create an account, verify your email address or phone number, or complete an OTP or similar security step to place an order or use certain features.

4.2 You must provide accurate, current and complete information when creating an account or placing an order. You must update your information if it changes.

4.3 You are responsible for keeping your login details, OTPs and device access secure. Do not share these details with anyone.

4.4 We may treat instructions sent from your account as authorised, unless you notify us before we act on those instructions and we have a reasonable opportunity to prevent the instruction from being carried out.

4.5 You must be at least 18 years old and have full legal capacity to use the platform or place an order. If you are under 18 or do not have legal capacity, you may only use the platform with the involvement and consent of a parent or legal guardian.

4.6 We may suspend, restrict or terminate your account, cancel orders, or refuse service where we reasonably believe there has been fraud, misuse, unauthorised access, suspicious payment activity, breach of these terms, or unlawful conduct.

5. Product sourcing and supplier information

5.1 MiHub Online sells products directly to customers through the platform.

5.2 Some products listed on the platform may be sourced from external suppliers, manufacturers, distributors or wholesalers.

5.3 Although MiHub Online may source products from external suppliers, MiHub Online does not operate as a third-party marketplace and does not merely facilitate sales between customers and third-party sellers.

5.4 Product details, images, specifications, manuals, compatibility information and warranty terms may be supplied by the relevant supplier, manufacturer or distributor. We take reasonable steps to ensure that product information displayed on the platform is accurate and up to date.

5.5 Where we become aware of incorrect, unsafe, unlawful or misleading product information, we may correct the information, remove the product, cancel affected orders or take other reasonable steps.

6. Product information, pricing and availability

6.1 We aim to keep product descriptions, images, prices, availability and delivery information accurate and up to date. Unintentional errors may occur.

6.2 Product images are for illustrative purposes and may differ slightly from the actual product, including colour, packaging, accessories or version, unless the difference is material or misleading.

6.3 Prices are displayed in South African Rand unless stated otherwise. Prices include VAT where VAT is applicable, unless clearly stated otherwise.

6.4 Delivery fees, handling fees and any other applicable charges will be shown before you complete checkout, where reasonably possible.

6.5 Products placed in your cart are not reserved until payment is completed and the order is accepted.

6.6 We may correct pricing, description, availability or technical errors before accepting an order. If an order has already been placed and the error is material, we may cancel the affected item or order and refund you in accordance with applicable law.

6.7 We may place quantity limits on products, restrict bulk purchases, cancel suspected reseller orders, or refuse orders where we reasonably believe the purchase is not for ordinary consumer use or breaches these terms.

7. Orders, acceptance and cancellation

7.1 Placing an order is an offer by you to purchase the products or services in your cart at the displayed price and on these terms.

7.2 An order is only accepted when we or the relevant seller confirm acceptance, dispatch, collection, fulfilment or other order approval. Payment confirmation alone does not always mean that the order has been accepted.

7.3 We or the relevant seller may decline or cancel an order where products are unavailable, the product or price was listed incorrectly, payment cannot be verified, fraud checks fail, delivery cannot be completed, a legal restriction applies, or there is another reasonable basis for cancellation.

7.4 If your order is cancelled after payment has been received, we will process a refund through the original payment method, subject to any lawful deductions and the rules of the relevant payment provider.

7.5 You may request cancellation before dispatch or fulfilment. Once an order has been dispatched, collected by a courier or prepared for fulfilment, cancellation may be treated as a return under the Returns, Refunds and Warranty Policy.

7.6 If a cancellation request is approved before dispatch, reasonable payment processing, courier, supplier or handling costs may be deducted only where permitted by law and disclosed or reasonably incurred.

8. Payment

8.1 We are committed to using secure online payment facilities. Payment transactions may be processed by approved payment providers using encryption and security measures appropriate to the payment method.

8.2 Available payment methods may include card payments, instant EFT, payment gateways, digital wallets, voucher payments, instalment payment options, buy-now-pay-later services or other payment methods shown at checkout.

8.3 You warrant that you are authorised to use the payment method selected and that the payment information you provide is accurate.

8.4 Payments may be subject to verification, fraud screening, authorisation, reversal, chargeback or delay by the relevant payment provider or bank.

8.5 If a payment is reversed, declined, charged back or suspected to be fraudulent, we may suspend the order, cancel the order, recover any products delivered, suspend your account or take other lawful steps.

8.6 Where a third-party seller supplies the product, MiHub Online may collect or facilitate payment on behalf of that seller.

9. Delivery

9.1 Delivery is available to addresses within South Africa, unless the product page or checkout process states otherwise or we agree otherwise in writing.

9.2 Delivery options, estimated delivery times and delivery fees will be displayed at checkout or communicated after order confirmation where applicable.

9.3 Delivery times are estimates only and may be affected by stock availability, seller processing times, courier capacity, payment verification, public holidays, peak periods, force majeure events or circumstances beyond our reasonable control.

9.4 You must provide a complete and accurate delivery address and contact number. We are not responsible for delays or failed deliveries caused by incorrect or incomplete delivery information provided by you.

9.5 You or your authorised representative may be required to present identification, sign for delivery, provide an OTP or otherwise confirm receipt of the order.

9.6 If delivery fails because you are unavailable, the address is incorrect, access is restricted or the order is refused without a lawful reason, we may charge reasonable re-delivery, return or storage fees, where permitted by law.

9.7 Risk in the products passes to you on delivery to you or your authorised representative, subject to any non-excludable rights you may have under consumer law.

9.8 Please inspect products on delivery where possible and report obvious damage, missing items or incorrect products as soon as reasonably possible through the returns process.

10. Returns, refunds and cooling-off rights

10.1 Returns, refunds, exchanges, damaged goods, incorrect products and warranty returns are governed by the MiHub Online Returns, Refunds and Warranty Policy, as updated from time to time, together with applicable South African law.

10.2 If you are a consumer under ECTA and the transaction qualifies, you may cancel an online purchase of goods within 7 days after receiving the goods, or an online purchase of services within 7 days after conclusion of the agreement, without giving a reason and without penalty, subject to the exclusions and conditions in ECTA.

10.3 Where ECTA cooling-off cancellation applies, you may be responsible for the direct cost of returning the goods, unless the law or our Returns, Refunds and Warranty Policy provides otherwise.

10.4 ECTA cooling-off rights do not apply to every transaction. Exclusions may include goods made to your specifications, goods that cannot reasonably be returned, goods likely to deteriorate quickly, unsealed software or digital media, services that have begun with your consent before the cooling-off period ends, and other exclusions allowed by law.

10.5 Approved refunds will generally be processed to the original payment method, unless another method is required by law, the payment provider, voucher terms or a specific refund arrangement approved by us.

10.6 Refund timing may depend on inspection, seller approval, courier return, payment provider processing times and the specific legal basis for the refund. Where a statutory refund period applies, we will comply with that period.

10.7 Products returned to us must be returned in the condition required by the Returns, Refunds and Warranty Policy and applicable law, including all accessories, manuals, packaging, serial numbers, tags and proof of purchase where required.

11. Warranties and defective goods

11.1 Products may carry a manufacturer warranty, supplier warranty, third-party seller warranty, direct manufacturer warranty or other product-specific warranty terms. Warranty details may appear on the product page, invoice, packaging, manual or manufacturer documentation.

11.2 Your rights under the CPA and other applicable laws apply in addition to any manufacturer, supplier or seller warranty.

11.3 If goods fail to meet the standards required by the CPA within the applicable statutory period, you may have the right to return the goods and choose a repair, replacement or refund, subject to the CPA and the facts of the matter.

11.4 Warranty cover may be refused where the issue was caused by misuse, negligence, accidental damage, liquid damage, electrical surges, unauthorised repair, alteration, failure to follow product instructions, normal wear and tear, consumable depletion, or damage after delivery not caused by MiHub Online, the seller or courier.

11.5 You must use, store, install and maintain products according to the manufacturer's instructions and must retain proof of purchase for warranty claims.

11.6 Where a direct manufacturer warranty applies, we may provide reasonable support and contact details, but the manufacturer may handle the warranty process directly.

12. Restricted products and lawful use

12.1 Certain products may be subject to age restrictions, licensing requirements, import restrictions, safety rules, usage limitations or other legal requirements.

12.2 You agree not to purchase, use, resell, export, import or distribute any product in a way that is unlawful or inconsistent with the product instructions, safety warnings or applicable restrictions.

12.3 We may request proof of age, identity, authority or eligibility before processing or delivering restricted products. We may cancel an order if the required proof is not provided or if a legal restriction applies.

13. Promotions, discounts, vouchers and bundle deals

13.1 Promotions, discount codes, vouchers, loyalty rewards and bundle deals are subject to their own specific terms, validity periods, stock availability and eligibility requirements.

13.2 Unless stated otherwise, promotional codes and vouchers are not transferable, may not be sold, may not be exchanged for cash, may not be combined with other offers and may be limited to one use per customer or order.

13.3 We may refuse, reverse or cancel a promotion, voucher or discount where it is used fraudulently, incorrectly, unlawfully, in breach of these terms or because of a technical error.

13.4 Bundle deals must generally be returned as a complete bundle unless the Returns, Refunds and Warranty Policy or applicable law provides otherwise. Partial returns may result in a reduced refund or adjustment of the bundle discount.

14. User conduct and prohibited activities

14.1 You may not use the platform in any way that is unlawful, fraudulent, harmful, misleading, abusive, defamatory, infringing, disruptive or inconsistent with these Terms and Conditions.

14.2 Without limiting clause 14.1, you may not:

  • use bots, scrapers, crawlers or automated tools without our written permission;
  • attempt to access, interfere with, reverse-engineer, copy or modify the platform, systems, source code, data or security features;
  • submit false information, impersonate another person or misuse another person's account;
  • use the platform to distribute malware, spam, harmful code or unlawful content;
  • misuse promotions, vouchers, payment facilities, returns processes or customer support channels;
  • infringe the rights of MiHub Online, sellers, customers, suppliers, licensors or other third parties.

14.3 We may investigate suspected breaches and may suspend or terminate access, cancel orders, remove content, report unlawful conduct or take other lawful steps where appropriate.

15. Reviews, submissions and user content

15.1 If the platform allows you to submit reviews, ratings, comments, images, questions or other content, you must ensure that your content is truthful, lawful, respectful and based on your genuine experience.

15.2 You may not submit content that is false, misleading, offensive, discriminatory, defamatory, unlawful, promotional, spam-like, infringing or unrelated to the product or service.

15.3 By submitting content, you grant MiHub Online a non-exclusive, royalty-free licence to use, reproduce, display, edit, moderate and publish that content for platform, customer support, marketing and operational purposes, subject to applicable law.

15.4 We may remove or moderate content that we reasonably consider to breach these Terms and Conditions or applicable law.

16. Privacy and personal information

16.1 We process personal information in accordance with POPIA and our Privacy Policy.

16.2 We may collect and process information needed to create accounts, process payments, verify customers, prevent fraud, fulfil orders, manage delivery, handle returns, provide support, communicate with you and comply with legal obligations.

16.3 We may share necessary personal information with payment providers, couriers, third-party sellers, suppliers, service providers, fraud prevention providers and regulators where required for the purposes described in these terms and our Privacy Policy.

16.4 Marketing communications will be handled in accordance with applicable law and any consent, preference or opt-out mechanism available to you.

16.5 You must keep your account and delivery information accurate so that we can fulfil your orders and communicate with you.

17. Electronic communications

17.1 You agree that we may communicate with you electronically through the platform, email, SMS, telephone, WhatsApp, push notifications or other contact details you provide, where appropriate and lawful.

17.2 Electronic records, notices, confirmations, invoices and communications may satisfy legal writing, signature or notice requirements to the extent permitted by ECTA and other applicable law.

17.3 Unless we expressly allow otherwise, legal notices to MiHub Online must be sent to the legal contact details listed in the Supplier Information and Notices section and not merely by social media message or informal chat channel.

18. Intellectual property

18.1 All rights in the platform, including text, graphics, logos, icons, images, product arrangement, software, code, databases, layout, design, trade marks and other content, belong to MiHub Online, its licensors, suppliers, sellers or other rights holders.

18.2 You may use the platform only for ordinary personal shopping and account purposes. You may not copy, reproduce, distribute, modify, scrape, frame, mirror, sell, exploit or create derivative works from the platform or its content without written permission.

18.3 No right, title or interest in the platform or its content is transferred to you by your use of the platform.

19. Third-party links, tools and services

19.1 The platform may contain links to third-party websites, payment services, delivery tracking pages, manufacturer resources or other external tools.

19.2 We are not responsible for the content, availability, security, privacy practices, terms or performance of third-party websites or services that we do not control.

19.3 Your use of third-party services may be subject to the third party's own terms and policies.

20. Availability, maintenance and security

20.1 We aim to keep the platform available and secure, but we do not guarantee uninterrupted, error-free or always-available access.

20.2 The platform may be unavailable due to maintenance, updates, outages, security issues, supplier integrations, payment provider downtime, courier system issues or events outside our reasonable control.

20.3 We may change, suspend, withdraw or restrict any part of the platform where reasonably necessary for operational, legal, security or business reasons.

21. Limitation of liability and indemnity

21.1 This section applies only to the maximum extent permitted by South African law and does not limit any liability or right that cannot legally be limited, including any non-excludable rights under the CPA.

21.2 We are not liable for indirect, incidental, special, punitive or consequential loss, loss of profits, loss of business, loss of data, loss of goodwill, or loss arising from platform downtime, except where liability cannot legally be excluded.

21.3 We are not responsible for loss caused by your breach of these terms, incorrect information supplied by you, unauthorised use of your account caused by your failure to secure your credentials, third-party service outages, or events outside our reasonable control.

21.4 You indemnify MiHub Online, its directors, employees, service providers and sellers against losses, damages, claims, penalties, costs and expenses arising from your unlawful use of the platform, breach of these terms, misuse of products, infringement of rights or fraudulent conduct, except to the extent caused by our gross negligence, wilful misconduct or breach of applicable law.

21.5 Nothing in these terms requires you to indemnify us for loss caused by our own gross negligence, wilful misconduct or unlawful conduct.

22. Changes to these Terms and Conditions

22.1 We may update these Terms and Conditions from time to time to reflect changes in our platform, suppliers, payment methods, delivery processes, legal requirements or business operations.

22.2 The updated version will apply from the date it is published on the platform, unless a later effective date is stated.

22.3 Continued use of the platform after updated terms are published means that you accept the updated terms. If you do not agree to the updated terms, you must stop using the platform.

22.4 Terms that applied when an order was placed will generally apply to that order, unless the change is required by law or is more favourable to you.

23. Complaints, disputes and consumer remedies

23.1 If you have a complaint, you should submit it in writing through the support channel listed on the platform or in the Supplier Information and Notices section.

23.2 Please include your order number, contact details, product details, photographs where relevant, a clear description of the issue and the remedy you are requesting.

23.3 We will investigate complaints and aim to respond within a reasonable time, taking into account the nature of the complaint, seller involvement, courier information, inspection requirements and any legal deadlines.

23.4 If a dispute is not resolved through our internal process, you may have the right to approach the Consumer Goods and Services Ombud, the National Consumer Commission, a court with jurisdiction or another appropriate regulatory or dispute resolution body.

23.5 This section does not prevent you or MiHub Online from seeking urgent or appropriate relief from a competent court where permitted by law.

24. Governing law and jurisdiction

24.1 These Terms and Conditions are governed by the laws of the Republic of South Africa.

24.2 You agree that South African courts have jurisdiction over disputes arising from or relating to the platform, your account, orders or these Terms and Conditions, subject to any consumer protection rights that cannot legally be waived.

24.3 If any clause in these Terms and Conditions is found to be invalid, unlawful or unenforceable, that clause will be treated as severed or limited to the extent necessary, and the remaining clauses will continue to apply.
